Lawyers for Bernard Antwi-Boasiako, the Ashanti Regional Chairman of the New Patriotic Party (NPP), and Akonta Mining Limited are set to sue the state for what they call “essential” documents missing from their case files.
The legal team announced its intention to file a motion compelling the prosecution to release the materials, which they argue are critical for preparing their defence.
Antwi-Boasiako, popularly known as Chairman Wontumi, and the mining company are on trial over allegations of illegal mining operations on their concession at Samreboi.
The move came during a case management conference on Tuesday, 25 November, which was meant to lay the groundwork for the trial.
Lead defence counsel, Andy Appiah-Kubi, notified the court that a formal application would be filed after the prosecution insisted that documents submitted on 31 October and 11 November were the complete set for its case.
Appiah-Kubi argued that the defence expected more documents, including materials the prosecution has but may not use as evidence, to aid their preparations.
The presiding judge directed the defence to file and serve the motion once ready.
The court also ordered the accused to submit the names and addresses of all their intended witnesses, in case the state establishes a prima facie case against them.
The case has been adjourned to 8 December 2025, at 10:00 a.m., to hear the defence’s application.
