The High Court in Accra, has granted an interlocutory and mandatory injunction restraining the publication of an online article deemed defamatory against businesswoman Niharika Handa.
The order, issued by Justice Kwasi Adjenim-Boateng of the High Court (General Jurisdiction 1) on October 23, 2025, followed an application filed by Ms Handa against three defendants, Anamale Edward Smith, Superweb Technologies Limited, and Amar Deep Singh Hari, in a defamation suit.
In her application, supported by an affidavit sworn by Prince Noel Danquah of East Legon, Ms Handa, an Indian, argued that continued circulation of the publication would cause her “grave, irreparable and continuing injury”.
The motion, filed through the affidavit of Mr Danquah and argued by counsel Thaddeus Sory, sought to restrain the defendants from publishing or causing the continued publication of an article titled “From Wanted to Ghana Citizen: How foreign fugitives allegedly use Ghana as a haven for fraud”, which appeared on GhanaWeb and other online platforms.
After hearing the arguments, the court held that leaving the publication online during the pendency of the case could result in serious and continuing harm to the plaintiff.
“It is hereby ordered,” the ruling stated, “that pending the final determination of this suit, Defendants/Respondents either by themselves, their servants, privies, assigns and all such persons hosting or causing to be published on the GhanaWeb news portal any words, articles or statements from ‘Wanted to Ghana Citizen: How foreign fugitives allegedly use Ghana as haven for fraud’ be restrained.”
The court further issued a mandatory injunction compelling the defendants and any affiliated persons to immediately remove the publication from GhanaWeb and any other online platforms.
It held that failure to do so could result in “grave, irreparable and continuing injury” to the plaintiff before the substantive matter is concluded.
The order was issued and sealed on Friday, 31 October 2025, by the Registrar, Doris Dansowaah.
