High Court orders fresh poll for Kpandai parliamentary seat

The Tamale High Court has directed a rerun of the parliamentary election in Kpandai, mandating that a fresh poll be conducted within 30 days.

The decision, delivered by Justice Emmanuel Brew Plange, follows a petition challenging the results of the 2024 parliamentary election in the constituency. The petition alleged irregularities in both the voting and collation processes, which, it argued, affected the credibility of the declared outcome.

The suit was filed by Daniel Nsala Wakpal, former Member of Parliament and the National Democratic Congress (NDC) parliamentary candidate for Kpandai. Wakpal contested the election of Matthew Nyindam, arguing that the vote held on 7 December 2024 was invalid.

According to Wakpal, inconsistencies were found in FORM 8A (Statement of Polls for the Office of Member of Parliament – Pink Sheet) in 41 polling stations out of the 152 in the constituency.

He asserted that the election did not comply with Regulations 39 and 43 of the Public Elections Regulations, 2020 (CI 127), and that these lapses materially affected the results.

Wakpal sought an order to annul the results from the 41 affected polling stations and requested that the Electoral Commission conduct a rerun in those stations on a date determined by the court.

In his judgment, Justice Plange upheld the petition, setting aside the declared results for the affected polling stations and directing the Electoral Commission to organise a new election to determine the rightful winner of the Kpandai parliamentary seat.
