The High Court in Accra has dismissed an application filed by lawyers for the former Director-General of the National Signals Bureau, Kwabena Adu Boahen, seeking to suspend his ongoing criminal trial.

Mr. Adu Boahen’s legal team had urged the Court to stay proceedings until the Court of Appeal delivers its ruling on a challenge they filed against an earlier decision by the trial court. That earlier ruling had partially dismissed a motion requesting further disclosures on behalf of the first and second accused persons.

However, the presiding judge declined the request, insisting that the trial would continue despite the pending appeal.

In a significant turn of events, the Attorney General and Minister for Justice, Dr. Dominic Ayine, has discontinued criminal proceedings against the third accused person, Mildred Donkor.

A notice filed at the High Court on Wednesday, 15 October 2025, indicates that Ms. Donkor was discharged under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30). Her name has since been removed from the charge sheet.

According to court sources, Ms. Donkor has agreed to serve as a prosecution witness in the ongoing GHC 49 million theft case involving Mr. Adu Boahen and his wife, Angela Adjei-Boateng.

Confirming the development after court proceedings on Thursday morning, her lawyer, Elikplim Agbemava, said she was officially discharged and will now assist the State in the prosecution of the matter.

Mr. Adu Boahen and his wife are standing trial over allegations linked to the misappropriation of GHC 49 million belonging to the State. The trial continues as the prosecution prepares to call its next set of witnesses, including the now-discharged third accused.
