Court slaps Ofori-Atta with costs in legal tussle with OSP

The Human Rights Court has dismissed an application by former Finance Minister Kenneth Ofori-Atta, describing it as a waste of the court’s time and awarding costs of GHS 5,000 against him.

The ruling, delivered on Tuesday, 25 November, saw the court throw out Ofori-Atta’s attempt to amend his writ and force the Office of the Special Prosecutor (OSP) to provide additional documentation, which the court deemed “unnecessary.”

This legal skirmish is part of a broader battle in which the former minister is challenging his designation as a “wanted person” and the arrest warrant issued against him by the OSP.

In March 2025, Ofori-Atta sued the OSP, alleging that the “wanted” notice violated his fundamental human rights to public image, administrative justice, and due process.

However, his latest procedural move has been firmly rejected. The court has adjourned the substantive ruling on his request to amend his original writ until 12 December 2025.

Following the court’s decision, the OSP took to its official Facebook page to welcome the ruling.

“Civil Suit: Ken Ofori-Atta v. OSP & AG. The Human Rights Court this morning dismissed an application by Kenneth Ofori-Atta seeking leave to amend his writ and to obtain discovery,” the OSP’s post stated.

It reiterated the court’s position, noting: “The Court held that the documents requested were unnecessary and awarded costs of GHS 5,000 against the applicant for wasting the Court’s time. The substantive ruling on the request to amend the original writ has been adjourned to 12 December 2025.”

The case continues.
