INEC: We’ll Engage N’ Assembly for Clear Legal Provision On Inmate Voting

The Independent National Electoral Commission (INEC) has said that it will engage with the National Assembly for a clear legal provision on inmate voting.

It added that thereafter, it could now address the specific issues that might arise in the course of implementation. 

INEC Chairman, Prof. Mahmood Yakubu, made this known on Friday in Abuja during a courtesy call by the Controller General of Nigerian Correctional Services (NCoS), Sylvester Nwakuche, that centred on the voting rights for inmates of correctional facilities who, at the moment, do not vote during elections and are therefore disenfranchised. 

He stressed that the commission was aware that the right to vote is a human right which cannot be taken away from a citizen on account of time being served in a correctional facility. 

Yakubu noted that in many parts of the world, including some African countries such as Ghana, Kenya and South Africa, where INEC officials observed elections, inmates exercised the right to vote. 

He noted that the commission was aware of the judgments of the Federal High Court in Benin delivered on December 16, 2014 and the Court of Appeal, also in Benin, delivered on December 7, 2018 pertaining to the right to vote by five plaintiffs awaiting trial. 

The chairman added that based on the combined provisions of Article 25 of the International Convention on Civil and Political Rights (1966) and Section 25 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) on citizenship, the court affirmed the rights of plaintiffs who were inmates awaiting trial to vote in elections. 

Yakubu said, however, the judges ruled that the right  to vote was only excisable when asserted as it is a choice to be exercised voluntarily by a citizen and not a duty to be imposed by force of authority.

According to him, “You may recall that in recognition of this situation, the commission had several discussions with the correctional service on how inmates who wish to register and vote in elections can do so.” 

Yakubu emphasised that the electoral body even set up a joint technical committee to review all the issues involved and advise on the way forward. 

He said the correctional service even availed them of data on the locations and types of federal correctional facilities nationwide. 

Yakubu stated: “You also provided us with statistics on the various categories of inmates, the majority of whom are on remand awaiting trial and who may actually be registered voters. 

“For our part, we raised the issue of access to the correctional facilities for voter registration, creation of polling units and voter education. On behalf of stakeholders and for transparency, we also brought to your attention concerns about access to your facilities for observers and the media. 

“Political parties also want to know if they will be allowed to campaign in the correctional facilities and appoint polling agents on election day. We believe that working together with you and the stakeholders, we can address these concerns.

“As you are aware, election is a process governed by law. Working together, we can seize the opportunity of the ongoing electoral reform for a clear legal provision that will specifically cover citizens serving time in our correctional facilities. 

“Doing so will also clarify the provision of Section 12(1)(e) of the Electoral Act 2022 on voter registration, a precondition for voting in elections, which restricts the exercise to a Nigerian citizen who ‘is not subject to any legal incapacity to vote under any law, rule or regulations in force in Nigeria’.

“There are various interpretations as to whether this provision relates to inmates on death row, those serving life sentences or those convicted for treason. 

“Our immediate task is to engage with the National Assembly for a clear legal provision on inmate voting. Thereafter, we can address the specific issues that may arise in the course of implementation.”

    President Bola Tinubu has commiserated with the Nigeria Police Force (NPF) over the demise of the 18th indigenous Inspector-General of Police (IGP), Solomon Ehigiator Arase, aged 69.
    Arase’s reforms as IGP and later as Chairman of the Police Service Commission brought lasting changes to the force.
    The President, in a release issued by his Adviser on Information and Strategy, Bayo Onanuga, commiserated with the family, friends and associates of the highly resourceful officer.
    President Tinubu acknowledged the dedication of the former IGP to enhancing security in the country, through initiatives such as the Intelligence Response Team, the Complaint Response Unit, and Safer Highway Patrols.
    Reflecting on Arase’s laudable service to the country, the President remarked, “Arase served the police force meritoriously from 1981 to 2016. During his career, he led tactical, operational, and intelligence units, including United Nations Peacekeeping in Namibia, the Commissioner of Police in Akwa Ibom, and the Principal Staff Officer to three IGPs.
    “He was Assistant Inspector General of Police in charge of Force Intelligence Bureau (FIB), and Deputy Inspector General of Police, Force Criminal Investigation Department.
    “After retirement, he continued to serve the nation in various public roles, including as Chairman of the Police Service Commission and as head of the Task Force on implementing the Edo State Anti-Community Development Association Law.
    “His expertise extended to consultancy roles with the Office of the National Security Adviser (ONSA), the European Centre for Electoral Support, the Human Rights Centre at the University of Oslo, and as a member of the Committee on Prevention of Torture in Geneva, Switzerland.
    “I pray for the peaceful repose of the soul of this dedicated security expert, whose experience and contributions will be deeply missed by our nation”.
    Also, President Tinubu expressed sadness over the passing of Bishop Francis Emmanuel Okobo, the pioneer Bishop of the Catholic Diocese of Nsukka, aged 88.
    “As the pioneer Catholic Bishop of the Nsukka Diocese, Bishop Okobo provided uncommon leadership and direction to the Catholic faithful, leading to the Church’s exponential growth in Nsukka Diocese.
    “As a priest and worker in God’s Vineyard, he lived an exemplary and impactful life, building the Church and guiding countless souls with love and wisdom,” the President said.
    President Tinubu commiserated with Bishop Okobo’s family, the Catholic faithful of Nsukka Diocese, and the people and government of Enugu State on the demise of this shepherd of the flock.
    He prayed for the peaceful repose of the revered clergyman’s soul.
    Bishop Okobo was ordained to the Priesthood in 1966 at 29 and served as a priest for 54 years.
    Following his Episcopal Ordination in 1991, he served as the Local Ordinary of the Nsukka Diocese for 34 years.

    Falana Calls on Govt to Extend Free Medical Services to All Indigent Pregnant Women

    Prominent Lawyer and human rights activitst, Mr Femi Falana SAN, has called on the federal government, state governments and the Federal Capital Territory to extend free caesarean section to all indigent pregnant women.

    In a statement on Sunday, Falana, who is the Chair, Alliance on Surviving Covid 19 and Beyond (ASCAB), said doing so was the only way to reduce maternal mortality and infant mortality to the barest minimum in Nigeria.

    Falana’s statement read: “Sometime in November last year, the Coordinating Minister of Health and Social Welfare, Prof. Muhammad Pate, announced that free caesarean sections would be provided to Nigerian women in need. The Minister made the announcement during the launch of the ‘Maternal Mortality Reduction Innovation Initiative.’

    “In April this year, the National Health Insurance Authority (NHIA) said it has commenced free Caesarean Sections (CS) for pregnant women in over 100 hospitals across the country. The Director-General of NHIA, Kelechi Ohiri, disclosed that the intervention is under the Comprehensive Emergency Obstetric and Neonatal Care (CEmONC) Programme.

    “Since the initiative represents a commitment to reducing maternal and newborn mortality across Nigeria, the federal government, as well as the state governments and the Federal Capital Territory, should extend it to all indigent pregnant women. This is the only way to reduce maternal mortality and infant mortality to the barest minimum in Nigeria.”
