Daddy Lumba and Odo Broni were never married – Sister tells court

A sister of the late highlife legend Charles Kwadwo Fosuh, known widely as Daddy Lumba, has told a Kumasi High Court that the musician was never married to Priscilla Ofori, popularly called Odo Broni, despite their long relationship and shared children.

Testifying on Wednesday, Ernestina Fosuh also known as Akosua Brempomaah, said her brother confided in her throughout his life, including matters concerning his relationship with Priscilla. She confirmed the pair had six children together, with the third child named after her, but insisted there was no marriage between them.

The testimony forms part of an ongoing legal dispute filed by Akosua Serwaa Fosuh, who claims she is the only lawful wife of the late musician. She is asking the court to declare her the sole surviving spouse and restrain Priscilla Ofori from presenting herself as Daddy Lumba’s widow.

Appearing before Her Ladyship Dorinda Smith-Arthur, Ernestina said her brother returned to Ghana to focus on a building project and to seek treatment for a back injury sustained in a road accident. She explained that Akosua Serwaa did not join him in Ghana because he discouraged frequent travel due to high airfare costs and what she said was a €50,000 loan he had taken in Germany.

However, defence lawyer Dominic Kwadwo Osei challenged this claim, arguing that no such loan existed and pointing out inconsistencies in the loan amount stated in earlier court filings. Ernestina insisted she was only recounting what her brother told her and said the evidence—“written in Dutch”—was on her phone.

The court also heard that although Priscilla Ofori cared for the musician during his illness, Ernestina maintained that her brother legally married Akosua Serwaa. She said she was present at the couple’s customary wedding in Bomso in 1991 and their civil ceremony in Germany in 2004.

Tensions rose when defence counsel tendered a video and audio clip suggesting Ernestina had previously acknowledged Odo Broni as her sister-in-law. In both clips, which were admitted as evidence, she appeared to refer to Priscilla as “Akumaa,” meaning sister-in-law. Ernestina told the court the recordings “sound like” her voice but insisted she stood by her testimony.

She also rejected claims that another woman, Theresah Abrebrese, performed in-law rites during their mother’s funeral, insisting the rites were carried out by Akosua Serwaa. She also recalled how the late musician attended Serwaa’s mother’s funeral dressed in black.

Defence lawyers further questioned Ernestina’s account of where the musician received medical treatment, noting that he underwent surgery at FOCOS Orthopaedic Hospital in 2013, not Tantra Hills as she suggested. Ernestina replied that she visited him at a hospital in Tantra Hills after returning from Germany.

The court adjourned proceedings with Ernestina expected to return to the witness box when the case resumes on Wednesday.
